1. About KelBail
KelBail is an online marketplace that connects students and young professionals looking for short-term housing (“Seekers”) with private individuals who have rooms or apartments to sublet (“Owners”). KelBail is not a hotel, a tourist accommodation platform, or a real estate agency — it is a peer-to-peer platform for residential short-term subletting. KelBail is operated by KelBail, Avenue Paul de Merten 14, 1090 Bruxelles, Belgium.
By creating an account or using any part of the platform, you agree to these Terms. If you do not agree, do not use KelBail.
2. Eligibility
- You must be at least 16 years old to create an account.
- You must provide accurate registration information.
- One person = one account. Duplicate accounts may be suspended.
- Accounts created on behalf of a company require prior written agreement with KelBail.
3. KelBail's role — we are a marketplace, not a party to leases
KelBail is a platform intermediary. We facilitate contact between Owners and Seekers but are not party to any rental or subletting agreement concluded through the platform. KelBail does not verify the legal right of an Owner to sublet, the accuracy of listing descriptions, or the suitability of any Seeker.
All agreements between Owners and Seekers are their own responsibility and must comply with applicable Belgian law, including the relevant regional housing codes (Brussels, Wallonie, Flandre) and any existing primary lease obligations regarding subletting.
4. Listings — Owner obligations
- Listings must be accurate, complete, and not misleading.
- You must have the legal right to sublet or rent the property.
- Photos must represent the actual space.
- Pricing must reflect the actual rent requested.
- You may not list the same property multiple times simultaneously.
- KelBail reserves the right to reject or remove any listing at its discretion.
5. Prohibited conduct
You may not use KelBail to:
- Post false, misleading, or fraudulent listings or profiles
- Discriminate on grounds protected under Belgian anti-discrimination law (art. 9 Loi du 10 mai 2007)
- Harass, threaten, or abuse other users
- Circumvent platform messaging to avoid fees (if applicable)
- Scrape, crawl, or extract data from the platform without written permission
- Attempt to gain unauthorised access to other accounts or platform systems
- Upload content that infringes third-party intellectual property rights
Violations may result in immediate account suspension or termination.
6. Content licence
By uploading photos, descriptions, or other content to KelBail, you grant KelBail a non-exclusive, royalty-free, worldwide licence to display, reproduce, and promote that content for the purpose of operating the platform. You retain all ownership rights.
You represent that you hold the rights to any content you upload.
7. Moderation
All listings go through a moderation queue before appearing in the public feed. KelBail moderators may reject listings that violate these Terms or our listing guidelines. Rejected listings receive a written reason and may be edited and resubmitted.
8. Payments
KelBail is currently free to use at launch. Listing fees and premium subscription plans are planned and will be introduced at a later date. You will be notified at least 14 days in advance of any new fees taking effect, as required under these Terms.
When fees are introduced, all applicable prices and conditions will be published on the platform. Refund and cancellation conditions will be clearly communicated at that time.
9. Limitation of liability
To the maximum extent permitted by Belgian law, KelBail's liability for any claim arising out of or related to the use of the platform is limited to the amount paid by you to KelBail in the 12 months preceding the claim, or €100, whichever is greater.
KelBail is not liable for: the accuracy of listings, the conduct of users, the legality of any subletting arrangement, loss of data, or indirect or consequential damages.
10. Governing law and disputes
These Terms are governed by Belgian law. Any dispute that cannot be resolved amicably will be submitted to the courts of Brussels, Belgium, unless mandatory consumer protection law provides otherwise.
Belgian consumers also have the right to use the EU Online Dispute Resolution platform: ec.europa.eu/consumers/odr.
11. Termination
You may delete your account at any time via Settings → Delete Account. KelBail may suspend or terminate accounts that violate these Terms, with or without prior notice depending on severity.
12. Changes to these Terms
We may update these Terms as the platform evolves. Material changes will be communicated by email and/or an in-app notice at least 14 days before they take effect. Continued use after the effective date constitutes acceptance.
